1. General Conditions of Use Applicability: Governs use of KLIA by airlines, aircraft operators, ground handlers, including Schedules 1, 2, and 3. Commencement Date: Effective from 10 July 2019, superseding previous conditions. Use of Airport Services and Facilities implies binding acceptance. Notification: MAHB will notify users of conditions; users are responsible for checking the website for updates. Amendments: MAHB may amend conditions after consultation with the airline operator committee, unless required by CAA, MAVCOM Act, or other regulations. Continued use after notification implies acceptance. Exclusion of Liability: Clauses exist that exclude MAHB's liability in certain circumstances. 2. Airport Services and Facilities Operation & Maintenance: MAHB operates, manages, maintains, and develops KLIA according to Malaysian laws (CAA, MAVCOM Act) and its license. Types Available: Services and facilities, along with corresponding Airport Charges, are detailed in Schedules 2 and 3. MAHB reserves the right to add new services and impose charges. Invoicing: Invoices reflect the types of services and facilities provided and their charges. Ground Handling: Ground handlers must comply with provisions in Schedule 2. Compliance: Use of airport and services must adhere to these Conditions of Use, applicable legislations (CAA, MAVCOM Act, Aviation Offences Act 1984), and world's best practices. Performance Principles: MAHB will maintain a secure, safe, efficient, comfortable, clean, and friendly airport environment, striving for continuous improvement. Due Care: Users, employees, agents, and contractors must exercise due care when using airport facilities and equipment. Excluded Services: Services not currently provided by MAHB (provided by third parties/Malaysian authority) include: Terminal navigation, air navigation, en-route, meteorological services. Air traffic control, aircraft engineering, medical services, public road services. Suspension/Termination: MAHB can suspend/terminate use of KLIA/services or ground handling performance for breach of terms, with notice for remediable breaches. Consequences on Cessation: Upon cessation of use or lease termination (14 days), users must remove aircraft/vehicle/equipment and pay all outstanding Airport Charges. Failure to remove may result in MAHB treating it as abandoned and disposing of it at user's expense, without liability. 3. Airport Charges Payment Obligation: Users must pay charges in Schedule 3 (passenger service, security, and other notified charges). Ground Handler Appointment: If a ground handler is appointed to pay charges, users must notify MAHB in writing, providing ground handler details and types of charges. Users are ultimately responsible if MAHB cannot recover from the ground handler. Taxes: Airport Charges are exclusive of and subject to applicable sales, services, consumption, goods and services, excise, value added, or like taxes, tariffs, and duties. MAHB can charge these taxes in addition. Invoices & Billing Portal: Invoices issued on the 1st of each month (or other specified interval) via fss.malaysiaairports.com.my . Invoices are deemed sent and accepted upon upload. Payment is due by stipulated dates, failing which late payment charges apply. Statements of Accounts: Monthly statements summarizing Airport Charges due and owing are provided. Conclusive Evidence: Users must notify MAHB in writing of any error or discrepancy in statements of accounts/invoices (regarding charges or services performed) within 30 calendar days. Failure to do so means the charges and services are deemed final and conclusive. Revision in Airport Charges: MAHB may amend charges after consultation with the airline operator committee (unless regulated by CAA, MAVCOM Act, etc.), with notice to users. Time of Payment: Charges must be paid by the due date on invoices, or for one-off/occasional services, before aircraft leaves KLIA, unless otherwise agreed. Currency of Payment: Airport Charges are calculated and payable in Malaysian Ringgit, unless otherwise agreed. Suspension of Use for Non-Payment: Failure to pay charges within 30 days of invoice date/due date may result in MAHB: Suspending use of Airport Facilities/Services or ground handling services. Recovering outstanding charges/late payment by forfeiting Security Deposit or exercising bank guarantee rights. Requiring advance payment for future Airport Charges. Taking legal action to recover outstanding charges/late payment. Detention/Lien: If charges are unpaid, MAHB has the right to detain and exercise a contractual lien over "User Properties" (aircraft, parts, accessories, vehicles, equipment, other property) on KLIA land or premises controlled by MAHB. This right continues even if the property leaves KLIA and returns. Storage/Security Charges: MAHB can impose Airport Charges, tax, levy, fee, cost, expense, and/or late payment charges for storage/security of detained User Property. MAHB is not liable for damage, loss, costs, expenses, or claims during detention. Notice of Demand: If outstanding charges remain unpaid, MAHB will dispatch a notice demanding payment within 14 days. Proof of dispatch is sufficient. Disposal of User Property: If full payment is not made by the due date, MAHB may, at its discretion, sell (by public auction or private contract with 14 days' notice), remove, destroy, or dispose of the User Property. Sale/Disposal Proceeds: MAHB is not obligated to obtain the best price and is not liable for losses from sale/disposal. Proceeds are applied first to discharge outstanding amounts, then to defray sale/disposal costs, with any balance accounted for. Preservation of Other Rights: Exercise of these rights is without prejudice to any other legal rights or remedies. Late Payment Charges: An additional 12% per annum on outstanding charges, calculated monthly from the due date until payment. Security Deposit: Users must provide a security deposit (cashier's order, cash, or unconditional/irrevocable bank guarantee in RM) by Commencement Date or as notified by MAHB. Amount specified by MAHB. Top-Up Security Deposit: Users must top up the security deposit if MAHB makes a deduction or if an increase is mutually agreed. No Set-Off: Users cannot set off or deduct from Airport Charges any claims they may have against MAHB, if they are a vendor of services at the Airport. Capitalization: Unpaid late payment charges are capitalized monthly and added to the principal sum, accruing further late payment charges. Overpayment: For overpayments, MAHB will notify users and issue a credit note for use against other amounts due. Information Required for Billing: Users must inform MAHB of changes in aircraft type, registration, MTOW, wingspan, length, and configuration. Relevant data for billing and statutory reporting (load message, passenger transfer message, etc.) must be provided electronically daily. Inadequate data leads to billing based on total seat capacity without exemptions. Changes in parking stands (including hangarage) must be promptly reported. Consolidation of Accounts: MAHB can combine, consolidate, or merge user accounts and set off any outstanding sums towards user liabilities with MAHB or Malaysia Airports Holdings Berhad group. 4. Compliance Conditions of Use: Users must comply with these Conditions of Use and pay Airport Charges by due dates. Insurance Policy: Users must comply with insurance policy requirements in Article 8. Applicable Legislations: Users must comply with CAA, MAVCOM Act, Aviation Offences Act 1984, and all other applicable Malaysian legislations, laws, and regulations (environmental, noise management, occupational health & safety). Users must not cause MAHB to breach any such legislations. Consequences on Non-compliance: Users are liable for and indemnify MAHB against expenses, liabilities, losses, claims, or penalties imposed by authorities due to user's actions, omissions, breaches, or defaults. If MAHB is penalized by authorities due to user's non-compliance, MAHB can deduct or set off the penalty against sums due to the user or Security Deposit. Safety and Security Directions: Users must comply with reasonable safety and security directions from MAHB or Malaysian authorities for KLIA operations. Instructions and Directions: Users must comply with MAHB's instructions and directions, including obtaining relevant operator licenses, airside driving permits, airside vehicle permits, and airport passes. Local Flying and Ground Restrictions: Users must comply with local flying and ground restrictions published in Aeronautical Information Publication ("AIP") or other relevant publications. 5. Parking and Aircraft Removal Security of Aircraft: Users are solely responsible for the security of their aircraft and contents, taking steps to restrict unauthorized access. Security Requirements: Users must provide reasonable evidence of emergency procedures complying with MAHB's security and safety requirements. Material Change to Information: Users must notify MAHB as soon as practicable of any material change to information provided that impacts charges or airport operations. Contact Details of Key Personnel: Users must provide contact details of key personnel for emergencies, security, or operational matters. MAHB will comply with privacy obligations. Monthly Summary Reports: Users must provide a monthly summary by flight of information from Schedule 1 within 14 business days after month-end. Discussion Forum: Issues regarding Airport Facilities and Services must first be discussed at the airline operator committee forum. Not to Land Passengers: Users are responsible for all "Not to Land" ("NTL") and offloaded passengers, bearing all costs (meals, safeguarding) until their departure. NTL/offloaded passengers must be deported immediately. Notification on Incidents/Accidents: Users must report the following incidents within the specified timeframes: Foreign Object Damage (FOD): Immediately. Wildlife strike: Immediately or when aircraft reaches end station. Accident/incident: Within 24 hours of occurrence. Information Submission: Users must complete and submit information in Schedule 1 before or as soon as practicable after arrival. Submission can be via email, office delivery, or fax. Movement and Removal of Aircraft: Users must use reasonable endeavors to move parked, damaged, or disabled aircraft within a specified reasonable time, subject to air traffic clearances and emergencies. Failure to Comply: If users do not comply with a request to move aircraft, MAHB may move/remove the aircraft at user's cost, notifying the user of date, time, new location, means used, and recovery conditions. Reasonable Notice: MAHB will endeavor to provide reasonable notice before moving an aircraft. If not possible, MAHB will notify as soon as possible after the move. No Liability for Removal: MAHB is not liable for loss or damage to aircraft, parts, accessories, or property, or third-party claims, caused directly or indirectly by MAHB moving/removing aircraft, unless done with intent to cause damage or recklessly. 6. Security Entry onto Airport Premises: MAHB endeavors to ensure only approved persons with legitimate authorization enter the security restricted area of KLIA. Security and Safety Measures: Users must comply with security and safety measures and requirements imposed for KLIA. 7. Airport Passes Application for Airport Passes: Users, employees, agents, and contractors must apply for airport passes to access restricted/controlled areas. Pass category/type depends on access area. Valid passes must be worn visibly and produced for inspection. Background Check: Users must conduct background checks on all employees, agents, and contractors working at the Airport. Application for Airport Passes: MAHB can conduct detailed police and law enforcement checks on applicants for airport passes, including criminal history. Conditions Governing Airport Pass: Issuance and use of passes are subject to Schedule 2, Schedule 3, applicable legislations (CAA, MAVCOM Act), and Regulations. Passes remain MAHB property and must be surrendered when no longer required. Charges for Airport Passes: Users must pay Airport Charges for airport passes as set out in Schedule 3. 8. Insurance Aviation Liability/Other Insurance: Users must maintain aviation liability insurance (aircraft third party, passenger, baggage, cargo, airline general third party, legal liability, war/allied risks) of at least RM50,000,000.00, or a higher amount specified by MAHB or prudent airline/operator. Other legally required insurances must also be maintained. Ground handlers need public liability insurance of at least RM50,000,000.00. Insurance must cover liability for terrorism acts. Minimum sums insured apply per occurrence, unlimited during policy period. Evidence of Insurance: Users must promptly pay premiums and provide reasonable evidence of insurances and premium payments upon request. Notification of Policy Cancellation: Users must notify MAHB as soon as practicable if a required insurance policy is cancelled or if an event occurs that may affect rights under the policy. Acts Affecting Insurance: Users must not do anything that adversely affects insurance rights or increases premiums. Insurance by Contractor/Supplier/Agent: Users must ensure any appointed contractor, supplier, or agent maintains specified insurances in their respective names. 9. Interruption to Airport Services and Facilities Unplanned Interruptions and Shutdown: MAHB endeavors to keep the Airport open, subject to operational requirements, maintenance, new developments, or events beyond reasonable control. In emergencies or for security/safety, MAHB may close parts of KLIA or suspend/interrupt services. MAHB will: Give reasonable notice (though not always possible). Minimize impact of closure/suspension. Planned Interruptions and Shutdown: For repairs, maintenance, upgrades, or construction, MAHB may close parts of KLIA or suspend/interrupt services. MAHB will: Give reasonable prior notice. Take reasonable steps to minimize impact. No Liability for Interruptions: MAHB is not liable for any loss or damage (profits, contract, goodwill, indirect/consequential loss, delays, third-party claims) due to planned or unplanned closures/interruptions of KLIA or services. 10. Indemnities and Release Your Indemnity: Users are liable for and must indemnify MAHB against any liability, losses, damage, costs, expenses, claims, actions, demands, and penalties arising from: User's use of Airport Services and Facilities. Breach of Conditions of Use, including loss/damage from MAHB exercising termination rights. Damage, loss, injury, or death caused or contributed to by user's act, omission, negligence, default, or employees/agents. MAHB doing something required of user under these Conditions of Use but not done by user. Overflow/leakage of water or fire in/from any area at KLIA used by user. Loss, damage, injury, or death caused or contributed to by user's use of KLIA or employees/agents' use. User's use/occupation of KLIA (including employees/subcontractors). MAHB exercising its right to detain, move, or remove user's aircraft. Any third-party claim arising from loss, damage, injury, or death due to user's use of KLIA/services. Your Risk: User's use of KLIA is at their own risk. Duty to Mitigate: MAHB's recovery under indemnity is not subject to a duty to mitigate losses or damages. Survival of Indemnities: Articles 10(a) to (d) are continuing obligations and survive termination of Conditions of Use. 11A. Release Release: Users release MAHB, its employees, agents, and contractors from liability or loss (profits, contract, goodwill, special, indirect, consequential loss) and costs arising from: Loss or damage to aircraft, parts, accessories, or property in aircraft at KLIA or during landing/take-off, unless done with intent to cause damage or recklessly. Damage, loss, injury, or death howsoever caused by MAHB's act, omission, neglect, or default, unless done with intent to cause damage or recklessly. Unavailability of services beyond MAHB's control (force majeure, labor disputes, weather, diversions, terrorism). Loss suffered due to delays or cancellations in aircraft movement/scheduling. Anything MAHB is permitted or required to do under these Conditions of Use. Items for Which We are Not Liable: Neither party is liable for incidental, indirect, consequential damages, loss of profits, business revenue, goodwill, or anticipated savings, even if informed of their possibility. Survival of Release: Articles 11A(a) and (b) are continuing obligations and survive termination of Conditions of Use. 11. Confidential Information Acknowledgment: Each party acknowledges the other's Confidential Information is its sole and exclusive property. Obligation of Confidentiality: Each party undertakes to keep the other's Confidential Information confidential, other than as permitted. Without prior written consent, a party must not: Disclose or communicate to any other person, except as permitted. Permit unauthorized access to places where it's displayed, reproduced, or stored. Make or assist any unauthorized use, and must ensure confidential undertakings from those with access. Permitted Disclosure: Either party may disclose the other's Confidential Information to employees, officers, agents, solicitors, accountants, and contractors in relation to its rights under these Conditions of Use, or if: Lawfully in possession from other sources. Required by law or a stock exchange. Strictly and necessarily required for legal or debt recovery proceedings. Generally and publicly available (not due to breach of confidence). Conditions of Permitted Disclosure: Both parties must ensure their representatives (employees, officers, agents, solicitors, accountants, contractors) comply with similar confidentiality obligations. Survival of Confidentiality: Obligations under this Article 11 survive expiry and termination of Conditions of Use. 12. Communication Agent Resident in Malaysia: If resident outside Malaysia, users must provide the name and address of a Malaysian agent authorized to accept communications. A replacement agent must be appointed if the current one is no longer able to act or resides in Malaysia. Methods of Service on You: Unless otherwise provided, communications from MAHB to users may be delivered by hand (including courier), post, or facsimile to the user's provided address or last known address. If sent by post: 3 calendar days after posting (within Malaysia), 7 days after posting (outside Malaysia). If sent by facsimile: At time transmission report is received, confirming receipt. 13. Disputes Resolution for Article 4(d): Disputes concerning Article 4(d) (non-compliance consequences) must first be discussed through consultation. Each party appoints a designated representative with authority to settle. If amicable resolution is not reached, Article 13(b) applies. Initiation of Legal Action: All other disputes under Conditions of Use are determined by Malaysian Courts, and both parties submit to their jurisdiction. 14. Notification of Damage or Defect to Airport Services and Facilities Notification: Users must immediately notify MAHB of any damage, defect, or malfunction of services/facilities. An inquiry will be conducted to determine the cause. Cost of Repair/Substitution: If the inquiry concludes the damage/defect was caused by user's act, omission, or employees/agents, the user is liable for all repair/substitution costs. 15. Governing Law Malaysian Law: These Conditions of Use are governed by Malaysian Law. 16. Entire Agreement Entire Agreement: These Conditions of Use constitute the entire agreement between MAHB and users regarding its subject matter, superseding all prior understandings, agreements, conditions, warranties, indemnities, or representations. 17. Definitions and Interpretation Definitions: CAA: Civil Aviation Act 1969 and all subsidiary legislation. Airport or KLIA: KL International Airport, including klia2, in Sepang, Selangor Darul Ehsan, Malaysia. Business Day: A day when banks are open for general banking business in Sepang, Selangor Darul Ehsan, Malaysia, excluding Saturday, Sunday, or public holidays. CAAM: Civil Aviation Authority of Malaysia. Commencement Date: 10 July 2019. Commission: Malaysian Aviation Commission. Confidential Information: All non-trivial, non-public information disclosed, provided, or obtained by either party in connection with business, or information that becomes public due to unauthorized disclosure or breach of confidence. Force Majeure: Circumstances beyond a party's reasonable control, including Acts of God, natural disasters, epidemics, pandemics, terrorist attacks, civil war, riots, war, sanctions, embargoes, diplomatic relation breaks, nuclear/chemical/biological contamination, sonic booms, governmental actions, building collapse, fire/explosion, accidents, labor disputes, strikes, industrial action, lockouts, exceptional diversion/landing of aircraft. klia2: Kuala Lumpur International Airport 2. MAVCOM Act: Malaysian Aviation Commission Act 2015 and all subsidiary legislation. Regulations: All regulations made pursuant to CAA and MAVCOM Act and other subsidiary aviation legislations. We, Us, Our: Malaysia Airports (Sepang) Sdn Bhd. Website: www.malaysiaairports.com.my You or Your: Person, firm, or company managing/operating an aircraft at KLIA, or appointed to perform ground handling services, or performing self-handling services. Interpretation: Singular includes plural and vice versa; gender includes other genders. Reference to Conditions of Use includes variations/replacements. Reference to a Schedule refers to a Schedule of these Conditions of Use. Reference to an article refers to an article of these Conditions of Use. Reference to a person includes a firm, partnership, joint venture, unincorporated association, corporation, body corporate, government, or statutory body. Reference to a person includes legal personal representative, executor, administrators, successors, substitutes, and assigns. RM: Ringgit Malaysia, the lawful currency of Malaysia. Headings: Do not affect interpretation. Discrepancies: If discrepancies exist between Conditions of Use and applicable legislation, the legislation prevails. SCHEDULE 1 - Information to be Provided to Us Aircraft Information (for all aircrafts using KLIA): Airline, aircraft, authorized maximum take-off weight (MTOW). Aircraft registration number, length, wing span, fuselage length. Maximum passenger capacity, aircraft noise certificate. Flight Information (within 24 hours of each flight): Aircraft registration number, flight number, origin, destination, date of flight. Scheduled/actual time of arrival/departure at KLIA. Block time of arrival/departure, terminal gate number. Passengers information (Table A), freight carried (tones). Agent/ground handler for the aircraft. Table A: Passengers Information Description NUMBER Seating capacity of Aircraft Total passengers on the Aircraft Deduct from Total passengers on the Aircraft the number of: 1. Heads of State, Ministers and other dignitaries visiting Malaysia as state guests TOTAL PASSENGERS for calculation of Passenger Service Charges and security charges (as set out Items 3 and 4 of Schedule 3) Notification of Changes: Users must promptly notify MAHB of any changes to this information (including flight schedules). SCHEDULE 2 - Airport Services and Facilities A. Use of the Apron Use at Your Risk: You use the Apron at your own risk. Conduct: No annoying, dangerous, or offensive conduct on or near the Apron. Dangerous Substances: No offensive, hazardous, or dangerous substances on or near the Apron without prior approval. Cleanliness: Keep Apron clean; no rubbish, obstacles, undergrowth, or FOD. If not complied, MAHB will clean at your expense. B. Landing Facilities Types Provided: Runways, taxiways, aeronautical ground lighting, other visual aids per ICAO Annex 14 Vol 1. Excluded Facilities: Navigation aid systems, air traffic control services (CAAM), and meteorological services (Meteorological Department of Malaysia) are provided by others. Landing Charges: Pay landing charges as per Schedule 3. Aircraft Escort ("Follow Me" services): Available upon request and payment (Schedule 3) to guide aircraft to parking bay if unable to reach it. Airside Services Charges: Pay charges for airside services as per Schedule 3. C. Parking Bays Aircraft Parking Bays: MAHB provides parking bays. Allocation: MAHB allocates bays daily based on airline-approved slots (NSCM) and daily flight schedules. Flight Schedule: Provide flight schedule with departure/arrival times, aircraft type, transit/overnight stop info. Change of Flight Schedule: Promptly inform MAHB of any changes to avoid misleading information. Parking Charges: Pay parking charges as per Schedule 3. D. Passenger Boarding Bridge/Aerobridge (PBB) PBB Availability: All contact stands have PBB. Allocation: MAHB allocates appropriate parking bay with PBB for aircraft type. Docking: PBB docking requires full clearance from your designated employee/agent. Unserviceability: If PBB is unserviceable, MAHB will notify and allocate an alternative bay. If no alternative, user must use movable aircraft stands or arrange passenger transportation. Remote Parking Bay: If remote parking bay is requested, user must provide passenger buses for transfer. Damage/Tampering: Do not damage, tamper with, or vandalize PBB. Ensure passengers do not cause damage. Employee/Agent Availability: Ensure employees/agents are available for PBB docking/undocking. Passenger Pathway: Ensure passengers are directed to the correct pathway. PBB Charges: Pay charges for PBB usage as per Schedule 3. E. Visual Docking Guidance System (VDGS) VDGS Availability: Contact stands with VDGS units are published in AIP. Parking Apron FODs: Ensure apron is clear of FODs and obstructions before/during arrival/departure. VDGS Operator Duty: Operator must have valid permit, attend annual training, standby 15 mins before arrival, activate/test VDGS, standby by OIP, chock aircraft, place chocks trolleys. Operator must produce permit for verification. Malfunction VDGS: If VDGS malfunctions, press EMERGENCY STOP BUTTON; operation continues by manual marshalling provided by user. Unserviceability VDGS: If VDGS is unserviceable, user must engage ground handler for marshalling at their expense. Mishandling VDGS: Ensure employees/agents use VDGS per SOP. Do not mishandle or damage VDGS. Damage/Tampering: Do not damage, tamper with, or vandalize VDGS. F. PBB Mounted Equipment Equipment Provided: Ground Power Unit (115V, 400Hz) and Pre-Conditioned Air Unit (ventilation, cooling, dehumidifying, filtering). Risk: Risk for Utilities passes to user when made available for use. Exclusive Use: Users must exclusively use MAHB's PBB Mounted Equipment unless otherwise agreed. Unavailability: If unavailable, user may procure alternative equipment at their expense until MAHB's equipment is available. MAHB is not responsible for services/utilities obtained elsewhere. Disclaimer: MAHB endeavors to make equipment available but is not responsible for: Failure to supply equipment/utilities or malfunction. Damage to assets or injury/death from functioning/defective/malfunctioning equipment. Quality/specification of utilities. Compliance with SOPs: Employees/agents/contractors must comply with SOPs for PBB Mounted Equipment. Handling: Employees/agents/contractors must be competent and trained in handling PBB Mounted Equipment per SOPs. MAHB may request proof of competency. Damage/Tampering: Do not damage, tamper with, or change PBB Mounted Equipment. Disrupting Programs: Do not introduce programs/devices that could cause equipment failure. Repair: Do not repair or attempt to repair damaged/broken equipment; notify MAHB immediately. Charges: Pay charges for PBB Mounted Equipment as per Schedule 3. G. Oil, Fuel and Hydraulic Fluid Spillage Cleaning: MAHB provides cleaning services for oil, fuel, hydraulic fluid spillage on tarmac, apron, taxiway, runway caused by aircraft/equipment/vehicles. Reporting: Report any spillage during refueling promptly to Airport Operation Control Centre. Dispatching Personnel: MAHB will dispatch personnel as soon as practicable upon discovery/report of spillage. Charges: The party causing spillage pays charges (Schedule 3) based on time taken to clean. H. Airside Solid Waste Management Domestic Waste: Dispose of domestic waste from premises into designated waste containers/bins at user's expense. Waste at ramp areas must be in plastic bags and tied. FOD Bins: Provided at parking bays. Users ensure only FOD wastes are thrown into FOD bins. User Bins: User bins require MAHB approval and can only be placed in designated areas. Scheduled Waste Management: Manage Scheduled Waste per Environmental Quality Act 1974 and Regulations. Collection/Storage/Disposal of Scheduled Waste: User is responsible for collection, storage, and disposal of Scheduled Waste at their expense, per Environmental Quality Act 1974 and Regulations. Notification: Inform Department of Environment and MAHB in writing of Scheduled Waste generated. Storage Area: Obtain MAHB's prior written approval for Scheduled Waste storage area. Hammerhead: Keep hammerhead free from domestic and scheduled waste. I. Aircraft Interior (AI) Cleaning Waste Management Plastic Bags: Use transparent/clear plastic/garbage bags with company logo, properly tied. Approved Locations: Place AI waste bags at designated hammerheads and remote bays. Collection: MAHB collects AI waste at designated locations based on flight schedules. Disposal: MAHB or appointed contractor disposes AI waste at Aircraft Waste Disposal Facilities (AWDF) to approved municipal landfills. User must verify and sign service sheet. AI Waste Management: User/cleaning contractor ensure AI Waste is managed per Conditions of Use. If AI Waste is found at PBB area, PBB will not retract until waste is removed. J. Aircraft Toilet Waste Management (ATWM) Your Obligations: Transport aircraft toilet waste via trucks to AWDF for discharge to KLIA wastewater treatment plant. Truck Driver Obligation: Driver must use AWDF properly, not mishandle it. After discharge, ensure areas are washed and clean. Charges: Pay charges for ATWM services per usage as per Schedule 3. K. Equipment and Motor Vehicles Conditions Permits: All user-owned/operated equipment/vehicles must have valid permits from authorities or MAHB. Maintenance: Maintain equipment/vehicles regularly, ensure serviceability, and take precautions against oil, fuel, hydraulic fluid spillage. Parking: Park equipment/vehicles in designated areas and operate within boundaries of use. Operator/Driver Competency: Operators/drivers must be properly trained for equipment/vehicles. Driving License/Airside Driving Permit: Operators/drivers must possess valid national driving license and MAHB-issued airside driving permit. Airport Traffic Rules: Maintain appropriate licenses/registrations and comply with airside driving rules/vehicle registration requirements. Breach of Traffic Rules: Breach of airport traffic rules/regulations may result in: Verbal/written warning. Compounding operator/driver. Confiscation of driving permit. Confiscation of offending equipment/vehicle if deemed dangerous. MAHB will notify user of confiscation and release items upon warning issuance or enforcement instruction. Airside Driving Permit/Vehicle Permits: Issuance is subject to terms/conditions in CAA, MAVCOM Act, Regulations, and this Schedule. Fees: Pay fees for permits as per Schedule 3. Permit Renewal: Apply for renewal of expired permits by submitting completed forms and fees. Buggy Usage: Comply with terms/conditions for buggy operation. Buggy Fees: Pay fees for buggy driving permit/equipment permit as per Schedule 3. L. Counters and Gates Allocation: MAHB allocates counters; number and position subject to availability. Cleanliness: Keep counters and surrounding areas tidy. No food/drinks. Remove equipment/stationery. Dispose rubbish in bins. Failure to comply results in MAHB cleaning at user's expense. Security: Take precautions to prevent unauthorized entry into counter area/conveyor. Leaving Counters: Leave counters secure and clean. Log off CUTE, close security barriers. Charges: Pay charges for counters as per Schedule 3. Unavailability: If a counter is damaged, MAHB equipment breaks down, or counter equipment is not supplied, MAHB will endeavor to provide a substitute. If no substitute, no charge for unavailable counter. Your Obligations: Pay for repairs to counter, MAHB equipment, or other property damaged by user/employees/agents/contractors. Our Obligations: MAHB repairs and maintains counters and MAHB equipment at its expense, except for user-caused damage. Responsibility for Employees/Agents/Contractors: User is responsible for their conduct and ensuring compliance with terms/conditions. Check-In Counters Equipment: Counters equipped with FIDS, Baggage Weighting Scales, CUTE with printers, Baggage tubs, conveyors, telephone, desk furniture. Manning Check-In Counters: User ensures counters are manned by employees/agents for smooth processing. Failure to comply may result in reduced counter allocation. Queueing Time: Passenger queueing time must not exceed 10 minutes per passenger. Departure Gates Lock: Lock gates after each use. Departure Gates Operation: Use boarding gate control panel for opening/closing. Change of Departure Gates: MAHB will inform of gate changes via PA system or FIDS. Additional Counters: Subject to availability, MAHB provides additional check-in counters if requested 30 minutes before opening. M. Counter Equipment and Our Equipment Ownership: Counter equipment (other than MAHB's) belongs to its owner or entitled person. Proper Care: Take care of all counter equipment, including MAHB's. Follow directions for use. Do not remove MAHB equipment. Repairs of Our Equipment: Notify MAHB immediately if MAHB equipment is not working or damaged. MAHB will repair. Do not allow unauthorized repairs. Exclusive Use of CUTE: Exclusively use MAHB-provided/installed CUTE unless otherwise agreed. Charges: Pay charges for CUTE as per Schedule 3. Meaning of Words: "Counters" includes Check-In, Transfer, Departure, Service, and Ticketing Counters. "Our Equipment" means MAHB-owned/supplied equipment/facilities (incl. Counters, BHS), excluding user/airline/third-party supplied equipment. N. Baggage Tubs Baggage Placement: All baggage that fits must be placed in tubs. One Baggage: Only one baggage item per tub. Placement of Baggage: Baggage must not be placed side-by-side or overlapping on scale or induction conveyor. Take Away Conveyor: Baggage introduced via automatic induction sequence; not manually loaded. If more, issue a yellow tag for each additional piece. O. Information Public Address Facility (PA Facility): MAHB provides PA Facility throughout Main Terminal and Satellite Building. Our Directions: Comply with MAHB's reasonable directions for PA Facility use. Your Use: Use PA Facility with reasonable care; announcements restricted to operational requirements. FIDS/BIDS: MAHB provides FIDS/BIDS at determined locations. Additional FIDS/BIDS: MAHB may install additional FIDS/BIDS panels in private areas nominated by user, provided user pays capital, connection, display device, and maintenance costs. Information Counter: MAHB provides information counters at KLIA to assist users/passengers with flight schedules, gates, and locations. Accurate Information: Ensure information given/displayed on FIDS/BIDS is current and accurate. Your Warranty: Data for user's logo/material in FIDS/BIDS remains user's property. User warrants copyright and non-infringement. P. Baggage Handling System (BHS) BHS: MAHB provides and maintains BHS for KLIA. Wifi Connectivity: MAHB provides Wifi connectivity at BHS ramp area for Baggage Reconciliation System (BRS). BRS is provided by user's vendor. Responsibilities: User is responsible for OOG baggage transfer, overflow clearing, and rummage chute management/clearance. Use of BHS: Comply with BHS performance specification (N-1.5) and any variations. Comply with MAHB's rules for BHS use. No Interference: Do not interfere with BHS efficiency. Damage/Tampering: Do not damage, tamper with, or vandalize BHS. Due Care: User/employees/agents must exercise due care in using/handling equipment for baggage loading/unloading, and comply with operational manuals/SOPs. Loading First/Last Baggage: Press "Start" and "Finish" buttons at breakdown conveyor before/after loading baggage. Baggage Reconciliation Facility: Use to reconcile actual baggage with boarding passenger. Baggage Tracing/Retrieval: Perform baggage tracing/retrieval with follow-up for missing, damaged, pilfered, or no-show passenger baggage. Container Dollies: Ensure adequate container dollies and ground service/loading equipment are available. Comply with Flight Load Handling Time. Damaged Dollies/Oversized Container Carriers: All ground services/loading equipment must be built with safety features and conform to specifications. Do not use damaged dollies/oversized carriers without MAHB approval. Positioning of Loading Equipment: Aircraft cargo holds closed 5 minutes before STD, with loading equipment on standby until departure. Position loading equipment within 1 minute of ATA. Mishandled Baggage: Re-tag and forward mishandled baggage to contracted destination. Your Obligations: Correctly tag baggage to final destination and issue Baggage Identification Tag. Enter/print baggage number/weight on Baggage Identification Tag. BRS handheld scanner: Ensure available, in good condition, employees trained, used at designated BHS ramp area, no misuse/damage. Delivery of Arrival Baggage from on-chock to breakdown conveyor as per On-Time Performance ("OTP"). Send Baggage Source Message ("BSM") to BHS on time (before baggage reaches Autobarcode Reader). Inform and test any new/changed BSM elements with MAHB. Scan departure baggage for reconciliation using BRS handheld scanner. Uncollected Arrival Baggage: Remove bags sorted to laterals in time to avoid full conditions and system congestion. Meaning of Words: "Baggage": Articles, effects, property for passenger's wear, use, comfort for trip. "Baggage Identification Tag": Tag attached to checked-in baggage with airline name, logo, passenger info, flight info, destination, number/weight. "Baggage Handling System" or "BHS": System for checked-in baggage conveyance at KLIA, including equipment. Q. Track Transit System & People Mover Track Transit System: MAHB provides track transit system between Contact Pier and Satellite A Building. If unserviceable, MAHB will notify and provide alternative transport. Our Directions: Comply with MAHB's reasonable directions for track transit system use. People Mover Systems: MAHB provides elevators, escalators, travellators. Do not use for administrative/operational goods/items. Goods Lifts: MAHB provides goods lifts for user's goods/items. Damage/Tampering: Do not damage, tamper with, or vandalize People Mover Systems/Goods Lifts. R. Security & Security Services Airport Passes: Employees/agents must wear airport security passes (showing name/position) on Apron and comply with directions. Fees: Pay fee for airport passes as per Schedule 3. Unaccompanied Baggage: Do not use counters/BHS to accept unaccompanied baggage/cargo. Passenger/Hand-Luggage Screening: All passengers/hand luggage must undergo security screening before entering sterile areas. "Sterile area" requires mandatory security screening of person/property. Baggage Screening: Only checked baggage from ticketed passengers at authorized locations allowed into BHS; all checked baggage must undergo mandatory security screening upon BHS entry. Random Searches: MAHB may require passengers/hand luggage/baggage to undergo random manual screening. Security Services: MAHB provides security services upon request and availability, per terms/conditions. This includes: Baggage Escort: Escort checked baggage from sorting area to aircraft to prevent tampering/additions. Baggage Surveillance: Surveil sorting area to prevent tampering/additions. Baggage Reconciliation: Tally all accepted baggage for interline/joining passengers. Diplomatic Mail/Precious Goods: Escort diplomatic mail/precious goods from aircraft to warehouse and vice versa. Baggage Identification: Ensure passengers physically identify/tally baggage claim tags against checked baggage tags before loading. Catering Security: Check/seal catering uplifts and escort from Cabin Services Building to aircraft. Hold Guards: Continuous security surveillance on checked baggage, cargo, stores at aircraft site until hold is closed. Aero-Bridge/Step Guard: Guard aerobridge/aircraft steps to prevent unauthorized access. Ramp Guard: Guard aircraft on ground to prevent unauthorized persons, deter conspiracy. General Cabin Surveillance: Surveil work in cabin and remain on board until aircraft departs. Aircraft Guard: Ensure security of aircraft parked overnight or undergoing repair. Handling of Risk Items: Convey risk items from security checkpoints to aircraft, or take custody of arriving risk items and restore to passengers. "Risk Items" are items deemed weapons by Malaysian laws. Valuable Cargo Armed Escort: Guard/escort valuable cargo from aircraft to warehouse and vice versa. Armed Guard: Provide armed security guards for escort/other duties. Checking Passports: Check passports/boarding passes at holding lounge entrances. Interline Baggage Screening: Screen all interline baggage for safety. Aircraft Bomb Search: Conduct external/internal aircraft search when under threat. Crowd Control: Conduct crowd control duties at check-in counters. VIP Escort: Provide escort for VIPs from terminal to aircraft and vice versa. Parcel/Cargo Consignment/Courier Screening: Screen parcels/cargo/courier consignments. Cargo Screening: Screen cargo. Other Security Services: Any other security services MAHB can provide. Provisions of Security Services: MAHB provides services for all scheduled/unscheduled flights, departures, arrivals, and joint services. Request for Service: If security services are required, immediately inform Security Division with estimated arrival/departure times. Charges: Pay for security services as per Schedule 3. Manifest of Valuable Goods/Cargo/Items: User must notify and provide manifest for valuable goods/cargo/items needing security services. MAHB will not enter aircraft without user's consent. Items not on manifest cannot be uplifted without consent. Risk items/dangerous goods cannot be uplifted without prior approval. Employee Availability at Gate Screening: Ensure employees/agents are available at Gate Screening: 90 minutes for A380, 60 minutes for other aircraft, prior to ETD. No Interference: Employees/agents must not interfere with/distract security screening. Passenger Presence: Advise passengers to be present at Gate Screening: 90 minutes for A380, 60 minutes for other aircraft, prior to ETD. Compliance with Rules: At all times, observe/conform to rules, regulations, directions, procedures for KLIA operation, management, maintenance, security, protection. Employees/agents/contractors must also comply. S. Airport Fire & Rescue Service Services Provided: Upon request and staff availability, MAHB provides Airport Fire & Rescue Service, including: Welding Work: Firefighter only or with water tender on standby for duration of work. Escorting Vehicle without Flame Arrestor: Escort for vehicles entering airside without flame arrestor. Hazardous Material Standby: Appropriate fire tender, equipment, and manpower on standby. Fuel/Other Spillages: Appropriate fire tender/water tender to wash Jet A1 fuel, hydraulic, diesel, and other spillages. Firefighting Demonstrations/Lectures: Conduct lectures/training/demonstrations. Water Supply/Cleaning/Pumping: Supply water from vehicle for utilities, cleaning, pumping. Fire Safety Standby: Firefighter only or with appropriate fire tender on standby. Other Services: Any other services MAHB can provide. Request for Service: If services are required, immediately inform MAHB. Charges: Pay for services as per Schedule 3. T. Staff Washroom Washrooms: MAHB provides clean and serviceable dedicated staff washrooms at ramp/terminal. MAHB will notify if unserviceable. Cleaning Services: MAHB provides cleaning services as scheduled. Your Obligations: Educate employees/agents/contractors on toilet ethics per Code of Ethics. Ensure no vandalism/misuse/damage to washroom facilities. Comply with Code of Ethics. Y. Signage Our Obligation: MAHB provides sufficient directive/informative signage for airport users. Your Obligations: Do not place commercial/promotional signage in KLIA. Obtain MAHB approval before placing informative signage; approved signage must comply with guidelines.
